Batsheva Shop Terms and Conditions

Definition

The Website serves as a virtual store for the sale of branded products and is owned and operated by the Batsheva Dance Company. Some products are in stock and others are made to order.

Batsheva Dance Company reserves the right to update the terms and conditions at any time at its reasonable discretion in the circumstances, and without prior notice.

Copyright

All intellectual property rights on the Website and/or products, including copyrights, models, methods and trade secrets, are the sole property of Batsheva Dance Company and/or third parties (as applicable).

It is prohibited to copy, reproduce, distribute, sell, market, modify, publish, transmit, display, perform, license, create derivative works of or reverse engineer, whether in whole or in part, whether temporarily or permanently, in any form whatsoever, any information from the Website, including trademarks (whether registered or not), pictures and texts, etc., without the prior written consent of Batsheva Dance Company and/or third parties (as applicable). Furthermore, it is prohibited to use the Website in such manner that constitutes, or may constitute, a violation or impairment of Batsheva Dance Company intellectual property, without its express prior written consent.

Pricing

All amounts and prices displayed on the Website include VAT (to the extent VAT is payable on the purchase under any law) but do not include delivery fees unless otherwise specified.

Batsheva Dance Company reserves the right to update the prices on the Website and/or the delivery fees from time to time, with no need for any prior notice. The price that is valid regarding an order made is the one published on the Website at the time the order process is completed (including entering payment details). If the price is revised before the customer completes the order process, they will be charged the new price. 

To redeem a discount code, the code must be entered before completing the order. Discount codes cannot be redeemed after the purchase is completed. In the case of returning a discounted item, customers will be refunded the discounted price.

Orders

To place an order and purchase products, customers have to create an account on the Website. 

Orders and/or purchases on the Website are subject to these Terms and Conditions, and pursuant to the provisions of the law, the Customer and/or anyone on their behalf will not have any claim and/or demand against the Website and/or Batsheva Dance Company and/or any of their directors and/or employees, in all regards to the provisions and conditions of these Terms and Conditions.

When placing an order and receiving confirmation from the credit card company, the customer will receive notification that the transaction was approved. In the event that the transaction was declined by the credit card company, the customer will receive notification and will be asked to provide another means of payment. 

All orders are subject to the availability of the product at the time of the order (even if the Website states that the product is available). If the product is not available, the order will be cancelled and the customer will be refunded. 

In the event that the order cannot be fulfilled for any reason, Batsheva Dance Company will contact the customer (using the details provided by the customer when opening the account or placing the order) in order to complete or cancel the transaction.

Payment

The Website is secure and all the details provided to Batsheva Dance Company by the customer remain confidential and secure. The payment process, including entering credit card details, is carried out in an external and extremely secure clearing system. Credit card details are not saved in the system.

After entering the credit card details on the payment page, the customer will receive email confirmation (to the email provided when opening the account) that the order details were received. This confirmation does not obligate Batsheva Dance Company to supply the products, and should be viewed solely as confirmation that the order details have been received. 

Business day

Weekdays (Sunday-Thursday), not including: the day of the order, Fridays, Saturdays, holiday eves, holidays, sabbaticals, Chol HaMoed, and memorial days.

Delivery

If the customer chose delivery, the products will be sent via Israel Post registered mail. The Customer will receive the tracking number, which will allow them to track the status of their order.

If the customer chose self pick-up, they can pick up the products at the Batsheva Dance Company Box Office on weekdays (business days only) between 09:00-17:00, after coordinating with the Customer Service Department and receiving a confirmation that the product they ordered is ready for pick up. 

Delivery fees are calculated according to the destination, weight and size of the package. 

In the event that the products are returned to Batsheva Dance Company due to providing incorrect delivery details, the customer will be charged an additional payment for delivery fees, according to the updated details they provide.

Cancelation and Returns Policy

This section is pursuant to the provisions of the Consumer Protection Law, 1981 (hereinafter: “the Consumer Protection Law”). The Customer has the right to cancel the transaction according to the Consumer Protection Law. 

The customer must return the product from the date of the transaction and up to 14 days from the date of receipt of the product, and in accordance to the “registered mail” account of the Israel Post, on the condition that the product was not used and or damaged in any way. They item must be returned in the exact same condition as it was sent. Product must be in its original packaging. Please include customer name, order number and telephone number. 

Products can be exchanged or returned in person by prior arrangement on a business day at the company’s box office or via registered mail to: Batsheva Dance Company, c/o Customer Service Manager, 6 Yehieli Street, Neve Tzedek, Tel Aviv, 6514947. The Customer will bear the cost of delivery. 

Transactions can be cancelled up to 14 days from the day the products were received, on the condition that they have not been used or damaged in any way. Upon cancellation, a fee of 5% of the transaction or 100NIS, whichever is lower, will be charged. There will be no refund on delivery fees. Transactions lower than 50 NIS cannot be cancelled. The refund will be made to the same means of payment used to complete the transaction. The refund will appear on the credit card statement in in accordance with the instructions of the customer’s credit card company.
